TERMS & CONDITIONS
The order booked is subject to the following terms and conditions, in addition to those mentioned on the front page of this document.


1. PRICE
The prices accepted under this order shall remain valid for a period of three (3) months only. The purchaser shall take delivery within this period by making the balance payment. In the event of delay beyond three months, the purchaser shall be liable to accept any revision or increase in price announced by the company.


2. PAYMENT AND RECEIPT
a) An advance payment of 30% to 50% of the total order value shall be made in favor of TECHFANATICS EQUIPMENT LIMITED.
b) Payments shall be accepted through DD, RTGS, or NEFT only. Cheque payments, if any, shall be made prior to dispatch and shall be subject to realization.
c) Interest at 24% per annum shall be charged on any amount remaining unpaid beyond the due date of the bill.
d) Material will be dispatched only after receipt of 100% payment.
e) For any cash payment, an official stamped and signed receipt bearing the company authorization and serial number shall be issued on the spot.
f) A scanned copy of the receipt will also be sent from the company official email ID: sales@techfanatics.in and techfanaticsindia@gmail.com, which shall be deemed valid for all purposes.


3. BILLING
a) All billing shall be raised by TECHFANATICS EQUIPMENT LIMITED.
b) Payments are to be made by DD, RTGS, or NEFT in favor of TECHFANATICS EQUIPMENT LIMITED, payable at Delhi.


4. DISPATCH AND DELIVERY
a) The equipment shall be ready for dispatch within the committed delivery timeline after booking. Actual dispatch will be made within one (1) week from the date of receipt of full payment. In case of payment by cheque, dispatch will be made within one (1) week after cheque realization only.
b) Should dispatch be delayed or hindered by the purchaser due to delayed balance payment or any cause beyond the control or responsibility of the company, the company shall not be held liable for any delay or consequential loss.
c) Goods once sold shall not be taken back under any circumstances.
d) Unloading of material at the customer site shall be entirely the customer responsibility. The customer shall arrange, at their own cost, the necessary forklift, manpower, or alternative means to unload paint booths, lifting equipment, or any other machinery or fabrication work.
e) The company shall not be responsible for any loss or damage to goods after dispatch from the factory or warehouse. Any loss or damage occurring during transportation shall be borne solely by the customer. Customers are strongly advised to obtain transit insurance for the goods prior to dispatch.


5. OBLIGATIONS OF THE CUSTOMER
a) The customer shall be responsible, at their own cost, for carrying out all necessary civil, electrical, plumbing, pneumatic, and installation-related work as per the company specifications.
b) During installation, the customer must ensure the availability of CVT, MCB, UPS, proper earthing, and water or oil filters, pipelines, or all types of oil as required.
c) Failure to provide these as per the company specifications shall render the warranty null and void.
d) If the equipment is not operated or maintained in accordance with the company recommendations and operating instructions, the warranty shall stand void.


6. WARRANTY STATUS AND VALIDITY
All equipment sold by TECHFANATICS EQUIPMENT LIMITED will be categorized as either With Warranty or Without Warranty. The warranty shall be valid only if explicitly mentioned on the invoice or bill issued by the company.
With Warranty: Equipment sold with warranty will have the period, scope, and conditions of warranty clearly specified on the bill. Warranty is valid only if the customer follows the company’s installation, usage, and maintenance guidelines.
Without Warranty or Not Mentioned: Equipment sold without warranty, or for which warranty is not mentioned on the bill, is provided strictly as is. In such cases, TECHFANATICS EQUIPMENT LIMITED shall not be liable for any defects, repairs, replacements, or consequential losses. The customer shall bear full responsibility for operation, maintenance, and associated risks.


7. SERVICE
After the expiry of the warranty period, the purchaser may enter into an Annual Maintenance Contract (AMC) for periodic servicing of the equipment at an additional cost. Details of AMC shall be provided upon request.


8. FORCE MAJEURE
TECHFANATICS EQUIPMENT LIMITED shall not be liable for failure to perform its obligations under this contract if such failure arises from causes beyond its reasonable control, including but not limited to:
Acts of God, fire, storms, earthquakes, explosions, accidents, strikes, lockouts, riots, war-like conditions, government restrictions or refusal of licenses, shortage of raw materials, or other unforeseen circumstances preventing fulfillment of obligations.


9. CANCELLATION OF ORDER
In the event of order cancellation by the customer:
a) A 30% deduction of the total order value shall be made towards administrative charges.
b) If the equipment has already been dispatched, the customer shall bear the to-and-fro freight or transportation charges from the company warehouse to the delivery destination and back.
c) Any government levies, duties, or taxes paid or payable in relation to such cancellation shall be borne by the customer and adjusted against the advance paid.
d) The balance, after applicable deductions, shall be refunded to the customer.


10. TAXATION AND FREIGHT
All applicable taxes shall be charged as per prevailing Government regulations. Freight shall be charged on actuals.


11. DISCLAIMER AND AUTHORITY TO MODIFY TERMS
No agent or employee of TECHFANATICS EQUIPMENT LIMITED is authorized to modify, amend, or waive any of the above terms and conditions, except with the joint written approval of all the Directors of the company, which must be formalized through a duly passed Board Resolution. Any modification, waiver, or amendment made without such approval shall be considered null and void.


12. JURISDICTION
All disputes and transactions arising out of or relating to this order shall be subject to the exclusive jurisdiction of the courts at Delhi, India.
